New Smyrna Beach residents alerted to inaccurate rezoning claims.

The City of New Smyrna Beach wants to inform residents of an anonymous entity that recently distributed an informational mailer to the residents concerning a proposed rezoning application that could pave the way for short-term rentals at a series of addresses along North Atlantic Ave. However, according to the city, these mailers have been found to contain inaccuracies regarding the legal implications of this proposed rezoning.

The addresses in question - 805, 807, 809, 811, 813, 815, 903, 905, 907, 911, 919, and 921 North Atlantic Ave - have been at the center of discussions related to rezoning in the area.

One glaring inaccuracy highlighted by New Smyrna Beach city officials pertains to the "Grandfathering Rights" established under Florida Statutes, which allow the city to continue the regulation of short-term rentals according to its prevailing ordinances. Contrary to the claims made in the mailer, the proposed rezoning would not constitute a revision of these regulations but a strategic adjustment enabling short-term rentals under the existing municipal provisions. The rezoning proposal would not jeopardize the city's standing or rights under the current legal statutes.

The New Smyrna Beach City Commission will discuss this matter as an agenda item during its regular meeting, scheduled for today, August 8, 2023, at 6:30 p.m., in the esteemed James W. Hathaway Chambers, at 214 Sams Ave.
